Experts describe the document as one that poses risks to Ukraine's economy and defense capacity during the prolonged war with the Russian aggressor.
The Ukrainian Union of Industrialists and Entrepreneurs (USPP), together with the Anti-Crisis Council for Economic Resilience under Martial Law, expresses deep concern over the Verkhovna Rada's decision to adopt Draft Law №6013. This document essentially provides for the repeal of Ukraine’s Commercial Code, the liquidation of municipal enterprises, and the introduction of provisions creating new corruption risks.
This position is based on the results of public discussions held by the USPP and the Anti-Crisis Council. Representatives of the business community, experts, judges, lawyers, and other specialists participated in these events. During the discussions, a unified position was expressed: Draft Law №6013 does not align with the country’s strategic interests. Its adoption may lead to devastating consequences for the economy and Ukraine's ability to produce its resources.
The corresponding resolution was sent to the President's Office, the Parliament, and the Cabinet of Ministers.
In times of war, Ukraine's economy faces unprecedented challenges that require urgent and effective measures to support and develop. The Russian Federation's military aggression against Ukraine not only causes devastating effects on infrastructure and enterprises but also creates new realities that necessitate adaptation to changes in the global economic environment. Adequate legal support for economic activity during wartime, considering Ukraine's European integration aspirations, is crucial for maintaining the country's economy and statehood.
An essential component of such legal support is the Commercial Code. It serves as the primary legislative act regulating entrepreneurial activity and provides legal certainty for businesses. Its repeal without establishing an alternative regulatory system creates a legal vacuum. This will complicate business operations, increase investment risks, and may lead to chaos in the field of economic relations. Leading associations of industrialists, local governments, judges, and lawyers have opposed the abolition of the Commercial Code under the provisions of Draft Law №6013.
